Terms and Conditions
- Quotations are subject to acceptance within 30-days of quotation.
- Terms are strictly COD unless credit has been approved by Pumps N Solar. Where been approved, terms are strictly net 30-days from end of month following the month of invoice. Where payments are not made within the above terms, Pumps N Solar may revoke discounts and may charge interest at the rate of 22% per annum calculated daily, in conjunction legal costs (on solicitor and/or own client basis) and agents fees incurred in recovering the amount outstanding. Where payment is not made in accordance with terms, Pumps N Solar reserves the right to immediately cease supply of goods.
- Pumps N Solar may withdraw credit facilities at their discretion without prior notice. This guarantee shall be revocable at any time by the Customer by one months notice in writing given, or in the event or death, provided written notification is given within 7-days by Customer.
- The Customer agrees to notify Pumps N Solar in writing of any changes of ownership within 7-day from the date of such change and indemnifies Pumps N Solar against any loss or damage incurred by its result of the Customer’s failure to notify Pumps N Solar of the change.
- Despite delivery of goods or any part thereof from Pumps N Solar, the title of goods shall remain with Pumps N Solar and shall not pass to the Customer until they have forwarded payment in full and discharge has been released on goods.
- The Customer will be deemed to have accepted the goods being in accordance with its order unless it notifies Pumps N Solar in writing of its claims within 7-days of receipt of goods.
- Orders placed with Pumps N Solar cannot be cancelled without written approval. In the event that Pumps N Solar accepts the cancellation of any order, they shall be entitled to charge a reasonable fee for any work done on behalf of the Customer to the date of cancellation, including a fee for the processing and acceptance to the Customer’s order and request for cancellation.
- Goods returned shall be in their original containers and should not be soiled: obsolete or damaged as such goods may be rejected. Except for the return of incorrectly supplied goods, freight is the responsibility of the Customer.
- Goods are sold "ex-store", and a delivery charge may apply to cover freight, unless delivery charges have been specifically included in the quotation.
- Every care is used in the packing, but, unless otherwise agreed, no responsibility is taken for the loss or damage in transit.
- Pumps N Solar does not guarantee availability of parts and will not be liable to compensate the Customer for loss or damage suffered because of unavailability of such parts. All warranties are subject to the discretion of Pumps N Solar, who provide the warranty, and must be approved in writing by the Supplier.
- The Customer hereby gives its consent to Pumps N Solar to the following matters in required under the Privacy Act:
- That Pumps N Solar may disclose information contained in this application and arising out of the operation of the account to a credit reporting agency, including without limitation the fact that an account has been applied for and the amount of credit applied for, details of any payments which have become overdue for which a collection action has commenced, any cheques that have been dishonoured, advise that payments are no longer overdue and that the credit provided has been discharged.
- That Pumps N Solar are authorised for the purpose of assessing this application and any later request for credit and/or for the collection of overdue payments in respect of credit which has been provided by Pumps N Solar, to request and obtain a credit report containing personal credit information about the Customer, and a report containing information about their consumer credit activities and credit worthiness from a Credit Reporting Agency and any Financial Institutions or Credit Providers named in this application or whose names are included in a credit report about their credit worthiness.
- Pumps N Solar may exchange certain information with other credit providers that they may obtain from: i. Any credit providers named in this application:
ii. Any authorised agent deemed to be a credit provider: and
iii. Any credit provider named in a commercial credit report issued by a credit or commercial reporting agency about the Customers credit arrangements, credit worthiness and credit history for the purpose permitted under Privacy Act.
Disclaimer
This clause shall operate to the extent permitted by law.
- Goods, which are delivered for repair, will be run or operated at the risk and responsibility of the owners only.
- Repairs of goods undertaken only on the condition that the owners give authority to run or operate the goods on their behalf.
- Neither the Company nor their staffs accept responsibility for the loss of or damage to the owner’s goods whilst such goods are in the custody of the Company.
- The Company shall not be liable for delays in repairs occasioned by labour of material shortage or by any cause whatsoever beyond the Company’s control, nor shall it be liable for repairs not providing satisfactory beyond the obligation to make good any defective part supplied or defective workmanship performed in effecting their repairs.
- The Company shall not be liable for any consequential loss or damage of any sum in excess of the amount paid on goods, arising out of breach of the above warranties.
